Canadian tax law firm Thorsteinssons has launched a Federal Court challenge to the Canada Revenue Agency's (CRA’s) proposed enforcement of the capital gains tax increase announced in the 2024 budget. The increase in the capital gain inclusion rate has not yet been enacted and cannot be in the near future because parliament has been prorogued.
Thorsteinssons' application alleges that the CRA is contravening the rule of law and is placing taxpayers in an untenable position, forcing them to either comply with the law or with the CRA. Either course could lead to significant financial repercussions.
